TERMS & CONDITIONS

1. Services

SkyPrairie Aerial Works provides aerial photography, videography, and custom drone services, including but not limited to:

  • Real estate photography and videography

  • Agricultural monitoring

  • Construction site documentation

  • Event coverage

  • Custom projects

We strive to deliver high-quality, professional-grade visuals. However, external factors such as weather conditions may impact the ability to complete certain projects. We reserve the right to reschedule services due to unsuitable flying conditions.

 

2. Booking and Payment

  • Booking Confirmation: Once you book a service, you will receive a confirmation email outlining the details of the service.

  • Payment Terms: Payment is required according to the terms of the selected service package. Invoices must be paid within 15 days of receipt unless otherwise agreed. Late payments may result in a $50 late fee.

    • For custom projects, a 50% deposit is required to secure the booking, with the remaining balance due upon project completion.

  • Rush Delivery: For expedited services (delivery within 24 hours), a $250 fee applies. This fee will be added to the final invoice.

  • Travel Fees: Travel beyond 45 miles from Watertown, SD will incur a mileage fee of $0.50 per mile for distances 15-45 miles and $0.75 per mile beyond 45 miles.

 

3. Cancellations and Rescheduling

  • Cancellations: If you need to cancel a service, please provide at least 48 hours’ notice. Cancellations made with less than 48 hours’ notice will incur a $100 cancellation fee.

  • Rescheduling: You may reschedule a service free of charge with at least 48 hours’ notice. If rescheduling is requested within 48 hours of the scheduled time, we may apply a rescheduling fee of $50.

  • Weather-Related Rescheduling: In cases where weather conditions prevent safe drone operation, we will reschedule the service at no additional cost.

 

4. Ownership and Licensing

  • Client Ownership Rights: Upon full payment, clients receive the right to use the images and videos for personal or commercial purposes, with the option to purchase 100% ownership rights (removal of logo and full copyright) for an additional $20 fee.

  • SkyPrairie Aerial Works Ownership: SkyPrairie Aerial Works retains the rights to all media captured unless the client purchases full ownership rights. We may use these images/videos for promotional purposes unless the client specifically requests otherwise.

 

5. Liability

  • Drone Operation: All drone operations will be conducted by FAA-certified pilots in compliance with FAA regulations. SkyPrairie Aerial Works is not responsible for any unforeseen accidents, delays, or damages caused by external factors during or after the project.

  • Damage to Equipment: If any damage is caused to SkyPrairie Aerial Works’ equipment due to the client's actions or negligence, the client may be held responsible for repair or replacement costs.

 

6. Privacy and Data Protection

  • Client Information: All personal information provided during the booking process will be used solely for the purpose of completing the service. We will not share or sell your information to third parties.

  • Aerial Footage of Private Property: We are committed to respecting privacy laws. We will not capture footage of areas where there is a reasonable expectation of privacy (e.g., backyards or through windows) without explicit permission.

 

7. Service Limitations

  • Weather Conditions: Drone flights are subject to weather conditions. High winds, rain, snow, or any other hazardous weather may result in rescheduling for safety purposes. SkyPrairie Aerial Works will not be held liable for delays caused by weather conditions.

  • Permits and Restrictions: It is the client’s responsibility to ensure that any necessary permissions or permits for the project location are in place before the scheduled service. SkyPrairie Aerial Works is not responsible for obtaining permits unless otherwise agreed in writing.

 

8. Dispute Resolution

  • Resolution Process: If any dispute arises regarding the service provided, both parties agree to resolve the matter in good faith. If the dispute cannot be resolved through informal discussions, it may be escalated to mediation or arbitration as necessary.

  • Jurisdiction: These Terms and Conditions are governed by the laws of the state of South Dakota. Any legal action must be filed within the jurisdiction of South Dakota courts.

 

9. Changes to Terms and Conditions

SkyPrairie Aerial Works reserves the right to update or modify these Terms and Conditions at any time without prior notice. Any changes will be posted on our website and take effect immediately.
